Distance contract

This Distance Contract (hereinafter – the Contract) is concluded between:

Seller: - Company name: SIA “Bergamo Baltic” - Registration No.: 40003355751 - Legal address: Brīvības gatve 293A–2, Riga, LV-1006, Latvia - E-mail: info@bergamo.lv

and

Consumer – a natural person who places an order in the Seller’s online store (hereinafter – the Consumer).

The Contract is concluded in accordance with: - Directive 2011/83/EU of the European Parliament and of the Council on consumer rights; - Consumer Rights Protection Law of the Republic of Latvia; - Cabinet of Ministers Regulation No. 255 “Regulations on Distance Contracts”.

1. GENERAL PROVISIONS

1.1. This Contract applies to all purchases made in the Seller’s online store. 1.2. By placing an order, the Consumer confirms that they have read, understood and agreed to the terms of this Contract. 1.3. The Contract becomes binding on both parties from the moment the order is confirmed.

2. ORDERING AND PAYMENT TERMS

2.1. The Consumer selects goods in the online store, adds them to the shopping cart and completes the order form. 2.2. Before confirming the order, the Consumer is provided with the opportunity to review and correct the entered information. 2.3. The Contract is deemed concluded when the Consumer receives an electronic confirmation by e-mail regarding receipt of the order and conclusion of the transaction. 2.4. Payment for goods can be made using: - payment cards; - payment upon receipt (parcel locker), where available. 2.5. All prices are indicated in euros (EUR) and include applicable taxes.

3. DELIVERY TERMS

3.1. Delivery of goods is provided via Omniva parcel lockers. 3.2. Delivery is available in Latvia, Lithuania and Estonia.

3.3. DELIVERY FEES IN LATVIA

·      Order value up to EUR 100 – EUR 3.90

·      Order value from EUR 100 – free of charge

·      Cash on delivery at parcel locker:

o   up to EUR 100 – EUR 6.80

o   above EUR 100 – EUR 2.90

3.4. DELIVERY FEES IN ESTONIA

·      Order value up to EUR 100 – EUR 3.90

·      Order value from EUR 100 – free of charge

·      Cash on delivery at parcel locker:

o   up to EUR 100 – EUR 8.80

o   above EUR 100 – EUR 4.90

3.5. DELIVERY FEES IN LITHUANIA

·      Order value up to EUR 100 – EUR 3.90

·      Order value from EUR 100 – free of charge

·      Cash on delivery at parcel locker:

o   up to EUR 100 – EUR 7.40

o   above EUR 100 – EUR 3.50

3.6. Delivery time does not exceed 7 business days, unless otherwise stated in the product description or order confirmation.

4. RIGHT OF WITHDRAWAL AND RETURNS

4.1. The Consumer has the right to withdraw from the Contract within 14 calendar days from the date of receipt of the goods, without giving any reason. 4.2. To exercise the right of withdrawal, the Consumer must send a notice in free form to info@bergamo.lv, indicating name, order number and a statement of withdrawal. 4.3. The goods must be returned to the Seller no later than 14 days after submitting the withdrawal notice. 4.4. The goods must be returned in the same way as they were delivered: - if purchased in-store – returned to the store; - if received via parcel locker – returned via parcel locker. 4.5. A return parcel locker code will be issued after the Seller has received the withdrawal request. 4.6. Return costs are covered by the Consumer, unless stated otherwise.

4.7. HYGIENE REQUIREMENTS

As the goods sold are sunglasses, the right of withdrawal may not apply if the goods are used, damaged, or no longer meet hygiene and safety requirements.

5. REFUND TERMS

5.1. The Seller shall refund all payments received from the Consumer within 14 days from the date of receipt of the withdrawal notice. 5.2. Refunds shall be made using the same payment method used by the Consumer for the initial transaction, unless agreed otherwise. 5.3. The Seller may withhold the refund until the goods are received back or proof of return is provided.

6. ORDER CANCELLATION

6.1. The Consumer may cancel the order if it has not yet been handed over for delivery by contacting the Seller at info@bergamo.lv. 6.2. If the order has already been dispatched, the Consumer may exercise the right of withdrawal.

7. DISPUTE RESOLUTION

7.1. Any disputes shall be resolved through mutual negotiations. 7.2. If no agreement is reached, the Consumer may contact the Consumer Rights Protection Centre of Latvia (PTAC) or use the EU Online Dispute Resolution (ODR) platform. 7.3. Disputes shall be resolved in accordance with the laws of the Republic of Latvia.

8. FINAL PROVISIONS

8.1. The Seller reserves the right to amend this Contract by publishing the updated version in the online store. 8.2. The laws of the Republic of Latvia shall apply.
